Important: These Terms constitute a legally binding agreement. By using ARAWNI services or clicking "I Agree," you agree to these Terms. If you do not agree, do not use our services.
These Terms of Service ("Terms") govern the relationship between ARAWNI LLC, a Florida limited liability company ("ARAWNI," "we," "us"), and you, the customer or user ("Client," "you"). By purchasing, accessing, or using any ARAWNI product or service, you agree to these Terms in full.
ARAWNI provides AI-powered business automation services including but not limited to: lead capture systems, automated email and SMS follow-up sequences, CRM tools, sales dialer software, proposal generation, and AI agent automation ("Services"). The specific services provided to you are defined in your subscription plan or a separate Service Agreement.
You may cancel your subscription at any time with 30 days written notice sent to hello@arawni.com. Your service continues through the end of the current billing period. We do not provide prorated refunds for partial months. If you cancel, you lose access to the platform and all data may be deleted 30 days after the final billing period ends.
Monthly subscription fees are non-refundable except in cases of (a) verified service outages exceeding 72 consecutive hours caused by ARAWNI, or (b) at ARAWNI's sole discretion for extenuating circumstances. Setup fees are non-refundable once onboarding has begun. To request a refund exception, contact hello@arawni.com.
ARAWNI does not guarantee any specific revenue outcomes, lead volume, close rates, or business results. All projections and estimates provided (including ROI Calculator outputs) are estimates based on industry averages and your inputs — not promises of future performance. Actual results depend on your industry, market conditions, team responsiveness, offer quality, and many factors outside our control. We will work diligently to deliver the promised features and support; we cannot control how those features perform in your specific business context.
You agree not to use ARAWNI services to:
Violation of acceptable use may result in immediate termination without refund.
ARAWNI retains all intellectual property rights in the platform, software, AI models, and documentation. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services during the subscription term. You retain ownership of your business data (leads, contacts, call logs) that you input into the platform.
Your use of ARAWNI services is also governed by our Privacy Policy. You are responsible for ensuring you have appropriate consents and rights to input third-party data (e.g., customer contact information) into the platform. You represent that your use of the Services complies with all applicable data protection laws.
Both parties agree to keep confidential any non-public information shared in connection with the Services. This includes your business strategies, customer data, and ARAWNI's proprietary systems and processes. This obligation survives termination of these Terms for 3 years.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARAWNI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO ARAWNI IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL ARAWNI BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA.
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ARAWNI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
You agree to indemnify and hold harmless ARAWNI LLC, its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Services in violation of these Terms, (b) your violation of any law or third-party rights, or (c) any content or data you submit through the platform.
ARAWNI targets 99.9% monthly uptime for core platform services. Planned maintenance windows are communicated in advance. Service credits for verified downtime exceeding 0.1% in a calendar month (approximately 44 minutes) may be requested by emailing hello@arawni.com within 30 days of the incident.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, in Hillsborough County, Florida. You waive the right to participate in class action lawsuits. Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
We may modify these Terms at any time. We will provide 30 days notice for material changes via email or platform notification. Continued use of Services after the effective date of changes constitutes acceptance. If you do not agree to modified Terms, you may cancel per Section 4.
These Terms, together with our Privacy Policy and any signed Service Agreement, constitute the entire agreement between you and ARAWNI regarding the Services and supersede all prior agreements or understandings.
